can be serious damage to the structure that, to the untrained eye, they wouldn't notice. >> reporter: now, as for the suspects, two men and a woman were arrested hours after pacifica police tried to persuade the troublesome trio to get off the boat. police say once they boarded the darling, they found what looked like an aftermath of a party, several open beer cans all over the deck, also they just said it appears that these people just drank too much and then just fell asleep on the boat. live in richmond, cate caugiran, kpix 5. investigators are still trying to determine whether there was any connection between the suspect and the boat's owner. this isn't the first boat this happened to. last september a man stole a 40- foot sailboat from an alameda marina and attempted to sail away with his two young children. he was caught off the coast of monterey. about two years ago a man stole a 38-foot powerboat in vallejo and ran aground at ocean beach.

the man was found aboard the dancing wolf drunk and it turns out he was celebrating his 35th birthday. >> it was big news in pacifica. i know lawrence you went down and got your camera out and took pictures. >> yeah. everyone out on the beach. >> they were out on the beach. they had some police tape around there so you couldn't go too far out. that's a huge boat and if that thing rolled out with a huge mast it could have come down and hit somebody. thank goodness it didn't happen. around the bay area, clouds rolling in and it looks like a chance of rain is on the way. hi-def doppler radar showing things are dry right now but i think that will change as we head in toward the evening hours as the cold front will slide into the bay area. you can see it right here slowly working its way towards california. some rain headed towards eureka right now. but it will take the better part of the day to work in our

direction. outside a lot of clouds, chilly in spots. 30s and some 40s this morning. by the afternoon, we're planning on highs only in the 50s and 60s. the winds will be kicking up and yes, it won't be long and then we'll talking about rain. back to you. rain is definitely not on the wish list for one san francisco neighborhood. sinkholes are opening up all over after a big water main break in the west portal is causing major problems for at least a half dozen homes. three homes been red-tagged and three others yellow-tagged. experts say the ground is still so saturated with water that the foundation of the homes are giving way. >> we are looking to replace the water main that broke the 16" up to vicente just to ensure we don't have any further problems with the age of the pipe. >> could be months before the ground is dry enough to make necessary repairs.

the city is paying for temporary housing for all the displaced residents. the water department expects to work on the water line every day for three months. it's the first murder in campbell since 2007 and police need your help. dozens of people gathered at santa clara high school for a candlelight vigil to remember 18-year-old richard vega. he was shot to death sunday night as he walked near the community center on latimer avenue. >> embrace life for what it is. it's fleeting. here's an 18-year-old kid who seems to have the world ahead of him and now there's nothing. >> he played football at santa clara high and was on the team that won a league championship last year. 5:05 now. los gatos leaders are giving themselves a little time to work on long-term guidelines for selling guns in their town. the town council voted unanimously last night for a moratorium on future gun sales. it's a temporary measure while they come up with a permanent

policy. templar sports is the only los gatos retailer selling guns and will be able to continue gun sales during the moratorium. other bay area headlines now. an assault rifle that someone stole from an unmarked san francisco police car has now been found. someone stole a similar gun to this one last saturday on mission street. the suspects broke a window, took the weapon and now police say the gun has been recovered but they are not saying how or where they found that gun. a suspect in the murders of three men in sonoma county is due to be arraigned today in a santa rosa courtroom. 46-year-old mark catell low was a-- cappello was arrested in alabama after the murders in forestville. investigators say the triple shooting was connected to a marijuana deal. a u.s. district court judge has appointed a compliance director to oversee the oakland police department's reform efforts. thomas frazier is the former police commissioner of baltimore, maryland and former deputy chief in san jose. his job is to get the opd to

comply with a set of reform measures that were supposed to be completed five years ago. the santa clara county board of supervisors will meet this morning to discuss how to replace george shirakawa in the district 2 seat. shirakawa resigned from the board last week. he now faces criminal charges involving improper use of campaign and public funds. the board will have to decide whether to appoint a replacement to finish his term or call for a special election. elizabeth has a look at the roads on this tuesday. >> so far at 5:07 we're doing well. a lot of overnight roadwork still out there looks like it's in the clearing stages along 880. so it was both directions of various lanes blocked northbound and southbound between 980 and high street this morning or approaching 23rd, excuse me. looks like there's a caltrans sign there in the distance if you look to the right side of the screen, roadwork still ahead lanes blocked. so looks like they haven't

picked it up all yet. let's go to our maps and more overnight roadwork this morning coming into fremont. northbound 680 approaching mission boulevard. scheduled to wrap up by about 6:00 this morning. the commute out of the altamont pass is a good one so far. it's going against the commute eastbound 580 approaching north greenville road. various lanes blocked, scheduled to be picked up around 11 a.m. lawrence has been talking about it, possibly a wet evening commute. bart is a good option. all trains are on time. that is traffic. back to you. >> thank you. new this morning, some new data confirms what many of us already knew: bay area drivers spend a lot of time behind the wheel commuting. kpix 5 reporter elissa harrington is at the bay bridge toll plaza with some new census data about so-called mega- commuters. i guess that's what we are, huh? >> reporter: yeah, we're not just commuters here. we're mega-commuters. that's not a good thing. it means we spend a lot of time on the road trying get to work.

we have one of the worst communities in the whole country but we also have among the most people who are actually making that bumper-to- bumper drive to get to the office. the latest statistics were put out by the u.s. census bureau identifying what they call mega- commuters. they spend at least 90 minutes to travel just 50 miles. the bay area tops the list. in san francisco, the peninsula and the east bay more than 2% of full-time workers are mega- commuters. in santa clara county, 1.9%. we are followed by new york and washington, d.c. new york 1.9% and in d.c. 1.89%. in most other major cities, less than 1% are mega- commuters. and for those non-mega- commuters things aren't so bad the national average commute time 25 minutes. the big difference you is don't travel as many miles so we are seeing these times in the bay area, as well. the report from 2011 shows a one-way commute time in santa

clara county was 24.7 minutes. almost 28 minutes in oakland. and about half an hour in san francisco. one of the reasons the bay area has so many mega-commuters is just the way that the region is laid out. we have sprawling suburbs, bridges and toll plazas where your car has to come it a complete stop and the bay itself really spreads things out so this is just one of the other costs of living here. at the bay bridge toll plaza, elissa harrington, kpix 5. >> to gather new data statisticians analyzed five years of data from full-time workers' responses in 2010. a special show at the bay bridge tonight. at 9:00 the new bay lights show will be switched on. for the next two years 25,000 tiny l.e.d. lights will turn the western span of the bay bridge into and i will lum nature art show. the lights will -- illuminated

hauling was demolished. impact sent debris flying. nobody seriously injured. can you imagine being in a car shooting this? oh, my god, is this going to happen? >> i would be flipping out a little bit. and that driver is so lucky not to be injured, elizabeth. >> i know. it's amazing how all this stuff is captured on video now. everyone has it on their cell phone and can find all this stuff on youtube. outside now, we are quiet in the traffic department nothing exciting going on so that's good news if you are going off to work. there are areas of overnight roadwork when they pick up a lot of it including up and down the south bay. we had some roadwork southbound 880 approaching coleman. that is now gone. so the rest of the south bay looks good this morning on the guadalupe parkway and 280. so here's the spot we're still seeing various lanes blocked coming into fremont. northbound 680 until about 6:00 this morning. they have three lanes blocked. it's still so early no delays

up 680 at all. similar story on westbound 580. a few brake lights. our first bit of changing color on our sensors so yellow means speeds around 40 miles per hour. it's not enough to impact drive time. going against the commute once again this is going on for the last couple of weeks eastbound 580 approaching north greenville various lanes blocked and this goes on until 11:00 this morning. that's a check on your "timesaver traffic." rain is coming our way. >> it's on the way on final approach here now. we are seeing clouds outside this morning early on today. i think the commute is going to stay dry. high-def doppler radar is showing you we have a couple of -- not much out there now. but by the afternoon it's going to get going. we are going to see our high- def doppler radar filled with raindrops and big changes as we head back to a wintry pattern. right now cloudy, temperatures in the 30s and 40s. this afternoon, the clouds will be gathering, windy, temperatures in the 50s and 60s. late in the day, into the evening hours, rain starting in

the north bay and spreading to the south as we head throughout the evening and nighttime hours. so here we go. you have this cold front slowly working in toward the bay area. behind that a lot of cold, unstable air so it's going to keep things going for today and toward the next few days. very unsettled weather coming in our direction. as we look toward the afternoon, here we go about 5:00 or so we begin to see showers entering into far northern parts of the bay area and then slides down as we head into 9:00 making its way across the rest of the bay area. scattered showers continuing into tomorrow. maybe some thunderstorms as we head into thursday. around the state you will see some 60s and 70s in the central valley, rain in the north bay. winter storm warnings for 7:00 this evening as we have changes coming in our direction and a lot of snow in the high country. maybe as much as 10 to 20" across the peaks. how about this? temperatures for 50s and 60s for highs today. looks like the next couple of days some unsettled weather will continue.

[ laughter ] much of the eastern u.s. is bracing for another major winter storm and snow is expected today from the mississippi river east to maryland and d.c. take a look at the early impact on st. paul, minnesota where rough weather means big business for the taxi industry. some cab drivers would rather not deal with it. >> give me dry roads and sunny skies and i'm much happier out here driving. >> oh, yeah. well, yesterday the dakotas felt the brunt of the harsh weather, blowing snow made it impossible for drivers to see very far. and it also kept so if plow and tow truck drivers busy but there were no major problems. americans already feeling

the effect of the sequester at the airport. homeland security secretary janet napolitano made a report on it. there will also be an effect on defense and security. congress has until march 27 to agree on a budget or we could see an entire government shutdown. wow. cbs news poll shows 53% of americans believe they personally affected by the cuts. 46% of those surveyed say the cuts will be bad for the country. and 34% say the cuts will have a positive impact. a new state law that bans school fees is causing some confusion. that's because it's not really clear where the money for much- needed classroom materials is supposed to be coming from. under the law, students can't be charged fees or be required to bring materials from home. but with little funding schools don't have the money to pay. one bay area teacher has paid

for supplies out of pocket. >> i want to make sure that we're giving all the kids at least a chance of having a quality art education so that's why i would pay. >> schools are now looking at creating booster clubs for academic programs as well as sports. a senior home nurse in bakersfield could face criminal charges now for not performing cpr on a dying woman. >> i understand if your boss is telling you, you can't do it. but if there's any -- as a human being, is there anybody that's willing to help this woman and not let her die? >> not at this time. >> they won't touch her at all. >> hard to believe. when a woman collapsed in the dining room of the home, the nurse called 911 but refused dispatcher directions to perform cpr on the woman who died. the nursing home is standing behind its employee, who refused to do that cpr. it's 5:20 right now.

richmond marina slowing being tugged into the area. it's going to make its way to a shipyard where they will assess in for damage. it was successfully pulled from pacifica shores just hours ago. and we have to tell you the darling had quite the journey yesterday morning. three people, two men and one woman, stole the sailboat from its sausalito home and tried to sail away with the sunrise. their plan was foiled when the keep was lodged at linda mar beach. early this morning, salvage divers went into the water to pluck the boat from the shore and we'll told it was a challenging dangerous process. ask there's a lot of danger involved in it. the divers had to swim out to the vessel and grab a boarding ladder and get up on it with a vessel rocking violently. >> reporter: now, the troublesome trio is behind bars. it took pacifica police hours to persuade them to get off that boat.

the owner of the boat yesterday didn't even know his boat was stolen until he saw it on the news. he hopes this morning as it heads to the shipyard that assessors will say there is minimal damage but we spoke with the owner of a salvage company who says to the untrained eye it looks okay but there could be some constructive damage. basically it was in the water for hours rocking back and forth so it's going to be one of those things where we'll have to see again but here it is, the 82-foot darling is back in the marina its journey far from complete. it will go to a shipyard where it will be assessed for damage. >> the owner will get that boat back at least. is there a relationship between the suspects and the owner. >> reporter: when i talked to the coast guard yesterday, they said at this point it's unclear what the relationship is between the two. but it will be part of the investigation. >> all right. cate caugiran live in richmond,

information on how or where they got it. today a ban on certain types of bullets in san francisco is expected to pass the board of supervisors. the goal is to outlaw the use of so-called hollow point bullets within city limits. that's the kind of ammo that can especially be lethal. 5:36 right now. let's check our roads. >> liz, that is your domain. take it away. >> thanks, guys. we are going to go out towards the "s" curve on the upper deck of the bay bridge. traffic heading towards treasure island. it's the little things this time of the morning. we have a new traffic camera there heading westbound 80 into san francisco, so far looks great across the upper deck. looking at the toll plaza too, not much of a delay there. no metering lights. elsewhere 880 a new lane configuration so heads up on northbound 880 near fifth and embarcadero it looks a little different. that was beginning yesterday. they did pick up that overnight roadwork in lanes though for the most part both directions between 980 and 23rd. looks great near the oakland coliseum. lawrence has been talking about it.

could be a wet evening commute home. so you may want to consider mass transit. so far bart more than 40 trains on time. muni, caltrain and ace also reporting no delay. but your popular drive times are so far in the clear as well including westbound 580 up and down the nimitz and heading down the eastshore freeway towards the macarthur maze. that's traffic. back to you guys. new this morning, it's official. bay area drivers spend a lot of time behind the wheel getting to work. kpix 5 reporter elissa harrington is at the bay bridge toll plaza this morning with new census data about mega- commuters. we're not surprised. >> reporter: not surprised that the bay area is one of the worst commutes in the country but what might be surprising is we have more people than any other city who actually bear this type of commute who actually sit in traffic and a lot of these mega-commuters are actually people like those behind me drivers coming in over the bay bridge to get to work. some travel at least an hour and a half to get about 50

miles. now, the latest report came out by the u.s. census bureau and has the bay area at the top of its mega-commuter list. these are full-time workers sitting through at least 90 minutes of traffic to get to work. most commuters around here are in san francisco, the peninsula and the east bay with more than 2% mega-commuters. in santa clara county, 1.9% of workers are mega-commuters. followed by new york with 1.9% and washington, d.c. with 1.89%. now let's look at nonmega- commuters to compare. the average one way time from santa clara county just under 25 minutes. oakland 27.8 minutes. and the san francisco commuters half hour. national average is 25 minutes. the difference here, those drivers are not traveling as far or during those peak hours. so bottom line, bay area workers are four times more likely to be mega-commuters and that's not likely to change

anytime soon. our bad traffic is connected to factors like large population, concentration of jobs in the city itself, bridges, toll plazas where a lot of cars have to stop, causing a backup of traffic. and the bay itself, which takes up a lot of room as we all know and kind of just tends to spread things out in general. so getting from point a and point b not as convenient as other cities. live at the bay bridge toll plaza, elissa harrington, kpix 5. to gather the new data experts analyzed five years of information from full-time workers' responses to census data through 2010. tonight the hayward city council plans to talk about red light cameras. police are suggesting the city get rid of them when the contracts expire. hayward put in eight cameras in 2008 to cut down on accident. there were some drop of broadside collisions but increase in rear end

collisions. north korea is threatening to cancel a cease-fire dating back to the korean war in 1953 because of possible new sanctions on the country. this comes as the united states and china have reportedly agreed to impose more sanctions on north korea following its nuclear tests last month. u.n. security council will be meeting behind closed doors this morning to discuss the issue. the united states will reportedly circulate a draft resolution at the meeting this morning. and the condition of venezuelan president hugh ga go chavez appears to deteriorating with a new severe respiratory infection. a statement said his condition is delicate. chavez is being treated for cancer and recently just returned back to venezuela after an extended medical stay in neighboring cuba. time now is 5:40. a fake priest pulls a fast one on cardinals at the vatican.

i guess it was towed in. >> reporter: you can see the darling or 82-foot yacht was towed in here a half hour ago. you can see it right now from here this sailboat will head to a shipyard where inspectors will take a closer look at the sailboat to see how bad the damage was. again, it made its way into the richmond marina about a half hour ago and salvage divers were successfully able to remove it just before 1:00 this morning. so yesterday the sailboat took a bit of a beating after its keel lodged the vessel in pacifica shows for several hours. it made its way from its sausalito slip after three people stole it yesterday morning. now those three people are behind bars and the owner hopes his boat can be saved. tim parker is the owner of parking diving services. his company towed the sailboat to richmond. he says the boat could still be a constructive total loss. >> the cost of repairs to the vessel could be greater than the insured value of
